1. Acceptance of Terms

By accessing or using the services provided by Med Card LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Services

Med Card LLC provides a platform that connects users with licensed healthcare professionals for medical evaluations conducted via telehealth or in-person consultations, in accordance with applicable laws.

We do not:

  • Provide medical treatment or ongoing care
  • Guarantee any specific outcome, determination, or approval
  • Prescribe, dispense, or distribute any controlled substances or cannabis products

All evaluations and recommendations are made solely at the discretion of the licensed healthcare professional.

3. Medical Disclaimer

The services provided are for informational and evaluative purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge that:

  • Any recommendation does not guarantee approval by any regulatory authority
  • All evaluations are based solely on the information you provide
  • Outcomes may vary based on individual circumstances and applicable laws

Use of the service is at your own risk.

4. Eligibility and Geographic Restrictions

Our services are currently available only to legal residents of Florida and Pennsylvania, where telehealth evaluation services of this nature are permitted under applicable state law. By using our services, you confirm that you are a legal resident of one of these states and meet all eligibility requirements under your state's applicable program.

We reserve the right to expand or restrict geographic availability at any time without notice. Users who access our platform from outside of approved states do so in violation of these Terms and may have their access terminated.

5. User Representations and Responsibilities

By using our services, you represent and warrant that:

  • You are at least 18 years of age
  • You are a legal resident of a state in which our services are available
  • All information you provide is accurate, complete, and truthful
  • You will comply with all applicable local, state, and federal laws and regulations
  • You will not use the platform for any unlawful, fraudulent, or misleading purpose

We reserve the right to deny or terminate access to any user at our sole discretion.

6. Telehealth Consent

By using our services, you consent to receive healthcare evaluation services via telehealth technologies, including video, audio, or electronic communications.

You understand that:

  • Telehealth may have limitations compared to in-person care
  • Technical issues may impact the quality or continuity of the consultation
  • You may withdraw consent at any time, subject to applicable laws
7. Privacy and HIPAA Compliance

We are committed to protecting your privacy and comply with the Health Insurance Portability and Accountability Act (HIPAA). Your Protected Health Information (PHI) will be used and disclosed only as permitted under applicable laws and our Privacy Policy.

We do not share health information or PHI with advertising platforms, social media networks, or marketing services under any circumstances. For full details, please review our Privacy Policy.

8. Payments and Refunds

All fees for services are disclosed at the time of purchase.

  • If you do not qualify following your physician evaluation, you will not be charged, or a full refund will be issued if payment was collected in advance
  • If services have been rendered and you have received a completed evaluation, payments are non-refundable
  • If a technical failure prevents completion of your evaluation, you are eligible for a full refund or rescheduled appointment at no additional cost
  • We reserve the right to modify pricing at any time. Price changes apply to future purchases only
9. Intellectual Property

All content on the VeriLeaf platform, including but not limited to text, graphics, logos, images, and software, is the property of Med Card LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our platform without our express written consent.

10. Third Party Links

Our platform may contain links to third-party websites or services. These links are provided for your convenience only. Med Card LLC does not endorse and is not responsible for the content, privacy practices, or accuracy of any third-party websites. Your use of third-party sites is at your own risk and subject to their respective terms and privacy policies.

11. Limitation of Liability

To the fullest extent permitted by law, Med Card LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data or profits, denial of eligibility or approval, or decisions made based on evaluations.

Our total liability for any claim shall not exceed the amount paid by you for the services in question.

12. Disclaimer of Warranties

All services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

13. Indemnification

You agree to indemnify, defend, and hold harmless Med Card LLC and its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the services, your violation of these Terms, or your violation of any applicable law or third-party right.

14. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services that cannot be resolved informally shall be resolved through final and binding individual arbitration, rather than in court.

Arbitration Process

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules: www.adr.org The arbitration shall take place in the State of Florida or another mutually agreed location and may be conducted via video conference.

No Class Actions

All disputes will be resolved on an individual basis only. Neither party may bring or participate in any class action, collective action, consolidated action, or representative proceeding.

Exceptions

This arbitration agreement does not prevent either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction.

Initiating Arbitration

To initiate arbitration, you must first send written notice of your claim to contact@buymedcard.com. If the dispute is not resolved within 30 days, either party may file for arbitration with the AAA.

If any provision of this arbitration section is found to be unenforceable, the remaining provisions shall continue in full force.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting. Continued use of our services following any changes constitutes your acceptance of the updated Terms.
